1. This Regulation may be referred to as the Contractual Obligations (Applicable Law) Act 1991 (Entry into Force) Order 1991. Upon the entry into force of those provisions, this Regulation shall bring into force the remainder of the 1990 Act for all other purposes. § In summary, the amendments to the 1990 Act contained in this draft regulation are minor, undisputed and necessary for that country to ratify the Convention of Accession of Spain and Portugal to the 1980 Rome Convention. As such, this regulation facilitates useful development in an important area of private international law, and I commend it to the Assembly. I ask for a postponement § The Convention was opened for signature in 1980. It was signed in 1981 and ratified in January 1991 after being transposed into UK law by the Contracts (Applicable Law) Act 1990. The reason for this delay was the time needed to negotiate two protocols to the Convention, which provide for the jurisdiction of the Court of Justice of the European Communities in certain cases under the Convention and which were signed in 1988. Ratification by that country was the last necessary for the Convention to enter into force on 1 April 1991.
The nine Member States at the time of its opening for signature of the Convention have now ratified it. § Although the right to extend this Convention to Gibraltar after the entry into force of this Ordinance would therefore remain unchanged, the Government has in fact decided to proceed with such an extension shortly. We see no reason to postpone it until after this regulation comes into force. No legislation was required in that country because Gibraltar had already enacted the necessary laws in its own legislation. § The Accession Convention of Spain and Portugal was signed in Funchal on 18 May 1992. It has followed this very closely for Greece and is largely formal in nature. It can be found in the list of the draft regulation, Article 9 of which will be included as a new list in the Contracts (Applicable Law) Act 1990. By Article 1, Spain and Portugal accede to the Rome Convention. Articles 3 to 7 concern texts, copies, ratifications and entry into force. Article 5 provides for its entry into force between States which have ratified it three months after its ratification by Spain or Portugal and another State party; thereafter, it shall enter into force for the other States on the first day of the third month following its ratification. It entered into force on 1 March 1994 for Spain, the Netherlands and Italy.
§ Certain matters are excluded from the scope of the Convention, including contracts more closely related to family law, trusts, wills and estates, certain insurance contracts and corporate law issues. There are specific provisions on employment contracts and consumer contracts intended to benefit the weaker party. Although the Convention is concluded between EC Member States, it applies to all contracts of a foreign dimension, whether or not it is an EC State, concluded before the courts of an EC State. GIVEN under my official seal, on November 30, 1991. This Protocol defines the scope of the jurisdiction of the Court of Justice of the European Communities with regard to the 1980 Rome Convention on the Law Applicable to Contractual Obligations and the Conditions for the Exercise of that Jurisdiction. This Convention determines which country the law should apply to treaties relating to more than one country. It was implemented in the United Kingdom by the 1990 Act and entered into force on 8 March 1991. I, RAY BURKE, Minister of Justice, in the exercise of the powers conferred on me by section 4(2) of the Contractual Obligations (Applicable Law) Act 1991 (No. 8 of 1991), hereby orders the following: CONTRACTUAL OBLIGATIONS (APPLICABLE LAW) ACT 1991 (COMING INTO FORCE) ORDER, 1991, 1991. This Regulation sets 1 January 1992 as the date of entry into force of the Contractual Obligations (Applicable Law) Act 1991. The Act brings into force the Convention on the Law Applicable to Contractual Obligations, signed in Rome on 19 June 1980, and a Convention on the Accession of Greece to that Convention. The Convention determines which law of the land is to be applied in a contractual case in which there is a choice between the laws of different countries.
(2) 1 January 1992 is the date of entry into force of the Contractual Obligations (Applicable Law) Act 1991 (No 8 of 1991). Gentlemen, if I may quote the last words of the noble and learned Lord, this order is fortunately undisputed. Of these benches, I have nothing to add to what the noble and learned Lord said so clearly. The United Kingdom ratified the Brussels Protocol on 29 January 1991, but until recently it was unable to bring it into force in that country because it was subject to ratification of another Protocol to the Convention by all Member States of the European Union that were Parties to the Convention. That second protocol confers jurisdiction on the Court. The launch of the Brussels Protocol became possible following Belgium`s ratification of the Second Protocol on 5 May 2004; it was commissioned internationally on 1 August 2004. § The noble and learned gentleman said: The purpose of this decree is to make some minor amendments to the Contracts (Applicable Law) Act 1990 to reflect 104 the accession of Spain and Portugal to the 1980 Rome Convention on the Law Applicable to Contractual Obligations. This Regulation brings into force on 1 March 2005 the following provisions of the Contracts (Applicable Law) Act 1990 (`1990 Act`): Article 2(1) in so far as it relates to the 1988 Brussels Protocol referred to in Section 1 and Section 3(1), (2) and (3), point (b). This brings this protocol into force for the United Kingdom. The Lord Chancellor and the Lord Advocate, in exercising the powers conferred on them by section 7 of the Treaties (Applicable Law) Act 19901, issue the following order: Different options for opening legislation in order to display more content on the screen at the same time Original (as enacted or done): The original version of the legislation as it was at the time it was enacted or promulgated.
No changes have been made to the text. 携帯電話のカメラを使用する – 以下のコードをススンし、Kindleアプリをダウンロードしてください。 § The purpose of Article 2 is to remove from the front of the Convention the reference to any European territory outside the United Kingdom for which the United Kingdom is responsible for international relations. § § The two fundamental principles of the Convention are in line with previous UK law, and their implementation has therefore led to few changes in our law. .
